"An upcoming Supreme Court case could answer one of the toughest questions of the internet age: Should online companies be held responsible for promoting harmful speech?
The case, Gonzalez v. Google, could upend the modern internet economy, sparing no online business. A ruling against Google will likely leave internet companies — from social media platforms to travel websites to online marketplaces — scrambling to reconfigure their businesses to avoid costly lawsuits.

The case, which will be argued Feb. 21, tests whether Google’s YouTube can be held liable for automated recommendations of Islamic State terrorism videos. The company is being sued by the family of Nohemi Gonzalez, a 23-year-old US citizen who was among the at least 130 people killed in coordinated attacks by the Islamic State in Paris in November 2015.
Since 1996, the statute at the center of the case, Section 230 of the Communications Decency Act, has protected online platforms from facing lawsuits for hosting toxic content and enabled the companies to remove posts as they saw fit. The Gonzalez case focuses on whether platforms are protected by the Section 230 shield when their own algorithms boost toxic material, videos and photos."
"Shelby Walker said she was watching a movie with her family on the evening of Feb. 3 when a 150-car Norfolk Southern train skirting the edge of town came off the tracks, sending 38 cars into a jumbled mass that caught fire and sent orange flames and black smoke into the sky.
On Tuesday, she watched as a machine with a scissor-like attachment shredded a scorched railcar that had fallen near the bicycles, trampoline and plastic play toys in her backyard. Over the clanging of steel being torn apart, Ms. Walker, 48 years old, said her family is still haunted by the accident, which sent chemicals into the air, ground and creeks leading to the Ohio River.
Like many people in and around this village, with a population of nearly 5,000, Ms. Walker, who works as a supervisor at a local hotel, said she is worried about contamination, distrustful of railroad and government officials and frustrated by what she described as a lack of clarity about what the continued risks are.
'I want to know what we’re being exposed to,' said Ms. Walker. 'People are looking for answers on how to deal with the situation we’re in.'
More than a week after the derailment, chemical odors continued to swirl Tuesday through the village on the border of Ohio and Pennsylvania. Railroad workers in yellow safety vests used heavy machinery to turn charred railcars into scrap and scoop up contaminated soil.
In another part of the village, contractors pumped material out of a creek near a deserted park and playground. Air and water monitoring continues, and many residents said they are worried about being back in their homes after being evacuated.
About a mile and a half away, Jerry Corbin has been collecting flakes of ash that he said appeared in his backyard in Darlington, Pa., after the operator of the train, Norfolk Southern Corp., drained and burned vinyl chloride from five tanker cars several days after the crash to prevent a catastrophic explosion."
"As US officials remain on high alert for spy balloons in the skies over North America, Chinese government operatives have already tapped into a network of local private investigators and federal agents to illegally obtain intelligence on the ground, according to a flurry of federal indictments.
Over the past few years, indictments filed against US-based private detectives allege that some have traded on their federal law enforcement connections to obtain classified documents and private information on political dissidents living in the US and targeted by the Chinese Communist Party.
In some cases, the private detectives offered their contacts in federal agencies wads of cash but they also got by with gifts of expensive cigars and a good bottle of tequila, according to a federal indictment unsealed in 2022.
Derrick Taylor, a California-based private investigator who used to work as a federal agent with the US Dept of Homeland Security, allegedly asked an unnamed co-conspirator for information on 'immigration status' for an unnamed dissident who lived in the US in July 2021, according to the indictment filed in Brooklyn federal court."

That’s Google’s argument to the Supreme Court, in a nutshell…
Next week, Section 230 of the UNITED STATES code will be put to the test. In short, Section 230 provides “…provides immunity for website platforms with respect to third-party content. At its core, Section 230(c)(1) provides immunity from liability for providers and users of an "interactive computer service" who publish information provided by third-party users.”
That third-party part is really important…
The challenge for Google, and others in big tech, is that they have technically become publishers - because they edit or augment content…
Which means they would not be protected by Section 230.
The thing that a Supreme Court opinion on this case that falls into the category of “Section 230 protections shouldn’t be used,” would do, is it would stop big tech from having their cake and eating it too…
Which is huge for you as a consumer…
No more vested interest for Big Tech in skewing things for money, when you can sue them into oblivion.
